2. OBJECT

To establish the conditions of sale related to the products offered through the website www.deepdrop.es.

The natural or legal persons who express their willingness to purchase products or services through the website indicated, will imply the acceptance of the particular conditions to which said purchase is subject, and must read and accept them before making the purchase.

The acceptance of the conditions of sale and the request for a product by the customer implies the formalisation of a contract of sale between The Company and the customer, who is of legal age and with full capacity to contract.

For the purchase of products through the website of The Company, although there is the option, it is not necessary for the customer to register in order to obtain a user name and password that allows access to the purchase of the products, although the customer must provide the necessary data at the end of the purchase in order to proceed with the invoicing, payment and delivery of the products.

In the event that the customer registers on the website of The Company, he/she will be held responsible for any purchase made, by him/herself or by a third party, in his/her name through the website using his/her user name and password.

Registration and purchase of products by a minor is not permitted. The Company will establish all the means of verification within its reach, but in no case will it be responsible for the minor having falsified his or her registration data and it will be understood to be carried out under the supervision and authorisation of his or her parents or guardians.

For the purchase or access to the “Irrigation Plan” section, it will be necessary for the user to register.

3. ACCESS AND REGISTRATION ON THE WEBSITE

Registration

In order to view and consult the articles on The Company’s website, the user does not need to register. You do not need to register in order to purchase these products, but you do need to register in order to access the “Irrigation Plan” section.

In the event that the user decides to register, at the end of the process, he/she will receive an email requesting verification of his/her account as a security measure implemented by The Company in order to avoid identity theft or non-legitimate use.

The data that will be requested for registration, both for private and business customers, will be as follows:

In the event that the user decides to register, the password must meet certain security requirements and can be changed or retrieved by the customer at any time by following the procedure indicated on the website.

In the event that the customer becomes aware that his access account may have suffered an intrusion or unauthorised use, he shall be obliged to notify The Company so that it may proceed to cancel it. Until such time as this is communicated, The Company is exempt from any liability.

You do not need to be of legal age to access the website and view the content, but you do need to be of legal age to make a purchase. In the event that the data entered is false, The Company will not be responsible for the use made by the minor, being the responsibility of the parents or guardians.

Cancellation

The customer may, at any time, exercise his or her right to cancel the account, without prejudice to the legal obligations incurred by the formalisation of purchases. In order to process the cancellation of the account, the customer must send an e-mail to info@deepdrop.es, indicating the text “REQUEST FOR ACCOUNT CANCELLATION”, and must identify himself/herself. The Company will take appropriate steps to confirm their identity.

The customer may reapply for a new registration, which will be granted unless there are reasons why The Company considers that it should not be granted.

4. STAGES OF THE E-PROCUREMENT PROCEDURE

Once the customer has selected the product or products offered by The Company, he/she must follow the phases of the contracting process indicated below:

1º- Once the customer has selected the product or products they wish to purchase, they must validate their shopping basket, which will show the products selected, the number of units, the price of the same including VAT and, if applicable, the delivery time and shipping costs.

2º- Once the customer has validated his/her shopping basket, he/she must provide The Company, by registering or filling in the requested fields, with the delivery and invoicing details, and must expressly accept, by ticking the corresponding box, the present Contracting Conditions, and it will be impossible to continue with the process if he/she does not do so.

3º- The customer will confirm the purchase and will receive an email detailing all the characteristics of the purchase which, in turn, will serve as proof of purchase. The invoice will be sent, if requested and once issued, by e-mail.

4º- The customer must select the shipping option and the payment method he/she wishes.

5º- Once payment has been confirmed by The Company, the product or products purchased by the customer will be sent.

5. METHODS OF PAYMENT AND PRICES

Prices:

The prices indicated on the website are those in force, unless there is a typing error, in which case The Company reserves the right to cancel the operation, include the corresponding taxes and are shown in euros, unless otherwise indicated.

Payment method:

Payment for the product can be made by the following methods:

For payment by transfer or deposit, the account number will be provided to the customer by e-mail when placing and confirming the order.

The Company recommends sending the proof of the transfer or deposit by e-mail to info@deepdrop.es in order to speed up the delivery process.

The order number will be provided to the customer together with the order confirmation in order to facilitate the identification of the order to which it corresponds.

The customer will have a period of 5 working days to pay for the purchase. If after this time the order has not been placed, the Company will proceed to cancel the order.

6. MODIFICATION AND CANCELLATION

You may modify or cancel your order within 3 hours of confirmation of your order by sending an email to info@deepdrop.es.

In the event of a refund, the customer will be reimbursed the full amount of the order via the same payment method used.

7. DELIVERY TIME AND SHIPMENTS

We ship to mainland Spain, the Canary Islands, Ceuta, Melilla and the Balearic Islands. As well as to all European Union countries.

The shipping cost in the cart when adding the products in the basket and the shipping area before order confirmation and will depend on the geographical area of delivery.

For orders of 210€ (excl. vat) or more, shipping costs will be free for the Iberian Peninsula (Spain, Andorra and Portugal).

The estimated delivery time is 48/72 hours after confirmation of payment for items in stock.

The goods will always be delivered within the agreed delivery time, unless the customer wishes the goods to be delivered later than the agreed delivery time, in which case the customer must indicate in the comments section the approximate delivery time of the goods.

In all cases, these deadlines shall start to run from the day of receipt of full payment of the order. Please note that if the customer places an order on a Friday, Saturday, Sunday or public holiday, even if DeepDrop® receives payment during these days, these days will not be counted as part of the delivery time.

Note: Public holidays other than Saturdays and Sundays are not included in delivery times.

The transport agency will deliver from Monday to Friday during working hours (Saturdays, Sundays and public holidays not included).

Note: Depending on the area, times may be slightly different.

The transport agencies, as a general rule, will not give notice before going to the delivery address, so The Company recommends that even if the customer knows the days on which the agency will deliver the goods, he should follow his usual rhythm of life. If the customer is not present at the address provided at the time the transport agency comes to make the delivery, a notification will be left for the customer to contact the agency and confirm a new delivery date, which may never exceed 10 days. The Company will personally monitor the shipment and if any incident should arise, it will contact the customer to inform him/her of the incident.

The Company reserves the right to choose the transport agency by which the order will be sent.

In the event of failure to meet the delivery date agreed in the order confirmation for each item by more than 10 days, the customer may choose to cancel the order and receive the amount paid. Non-delivery shall not be considered as such if the transport agency has not been able to locate the customer by means of the data provided by the latter.

The customer will be notified by the Company by e-mail or telephone call on the day the goods leave the Company’s premises for the customer’s address. If, for reasons attributable to the customer, the goods cannot be delivered on time, all costs incurred in bringing the goods to the Company’s premises shall be borne by the customer, as shall the subsequent return of the goods.

8. RETURNS

The customer will have 14 working days from receipt of the order to cancel the order, for which he/she must contact DeepDrop® to proceed with the processing, either by telephone at 672329393 or by email at info@deepdrop.es. The customer must bear in mind that he/she will have to pay the transport and administrative costs generated by the return, if the return is due to causes beyond The Company’s control. These costs will vary according to the product purchased (*). In case of return, the goods must be in their original packaging and the products must not be unsealed or partially consumed. The agency will collect the goods in the same condition as they were delivered. The customer should note that if the item is not in the aforementioned condition when it arrives at DeepDrop®, it will be returned to the customer and the customer will be charged the corresponding return shipping costs. (*)In the case of returned goods: Credit will be made within 30 days from the date of receipt of the goods.

In the event of cancellation of the order prior to delivery: Credit will be made within 30 days from the date of the cancellation request.

Note: If the complaint is made some time after the goods have been delivered, if the customer does not have the original packaging, he will have to pack the goods himself so that they arrive at their destination protected.

In the event that the product is returned as defective, it will be replaced by one of the same characteristics, and the Company will assume the shipping costs.

In the event that the delivered product does not correspond to the one requested by the customer, it will be replaced with the correct one at no additional cost to the customer.

In the event that the manufacturer determines that the product delivered does not present anomalies or deficiencies due to normal use or manufacturing defects, the customer shall be obliged to pay the transport and handling costs incurred.

The refund will be made by the same means of payment with which the customer made the purchase.

9. WARRANTY

All products are guaranteed for 36 months, except where otherwise stated.

Damage resulting from misuse of the product by the customer shall not be covered by the warranty. The guarantee that The Company offers on its products expressly excludes the following cases: Incorrect use, handling or maintenance of the product by the customer.

The warranty period starts from the date of purchase of the product. The date of purchase will be confirmed on presentation of the invoice.

Intervention during the warranty period does not extend the initial warranty period.

In the event of an incident with the purchased product, the customer must contact The Company by e-mail at info@deepdrop.es, indicating in the subject line: ” WARRANTY REQUEST” and a brief description of the problem or the reason for the request. The Company will contact the customer to provide a solution to the problem as quickly and efficiently as possible.

Transport damage:

The customer has a period of 24 hours from receipt of his order to report any damage he may notice as a result of transport. In this case, you must notify The Company by e-mail to info@deepdrop.es, indicating in the subject: ” TRANSPORT DAMAGE”. The customer must provide his details, the order number and photos of the condition of the packages, as well as indicate any anomalies. No claims will be accepted regarding the condition in which the goods were delivered after the aforementioned period of 24 hours.

The customer must bear in mind that he/she will have to pay the transport and administrative costs generated by the return, if the return is due to causes beyond The Company’s control. These costs will vary according to the product purchased (*). In case of return, the goods must be in their original packaging and the products must not be unsealed or partially consumed. The agency will collect the goods in the same condition as they were delivered. Please note that if the item is not in the aforementioned conditions when it arrives at the Company’s facilities, the return will be rejected and, in this case, the customer will be offered the possibility of sending it back to you, charging you the corresponding return postage costs. If the customer requires further information, please contact the sales department of The Company.

(*) In the case of returned goods: Credit will be made within 30 days from the date of receipt of the goods.

The transport costs incurred in returning a product shall be borne by the customer. For this reason it is the customer who chooses the means of delivery. The exceptions attributable to The Company apply to this point and are detailed below.

In the event of cancellation of the order prior to delivery: Credit will be made within 30 days from the date of the cancellation request.

The customer will have a maximum period of 30 working days from the acceptance of the return to return the product or products to The Company.

Note: If the complaint is made some time after the goods have been delivered, if the customer does not have the original packaging, he will have to pack the goods himself so that they arrive at their destination protected.

In the event that the product is returned as defective, it will be replaced by one of the same characteristics, and the Company will assume the shipping costs.

In the event that the delivered product does not correspond to the one ordered by the customer, it will be replaced with the correct one at no additional cost to the customer.

In the event that the manufacturer determines that the product delivered does not present anomalies or deficiencies due to normal use or manufacturing defects, the customer shall be obliged to pay the transport and handling costs incurred.

The refund will be made by the same means of payment with which the customer made the purchase.
